ExpressToll User Agreement


In order to provide the greatest convenience to ExpressToll customers, customers may pay their tolls automatically through the use of an ExpressToll account.

OPENING A TOLL ACCOUNT

Credit Card Account: The customer's credit card will be charged to establish a Toll Account Balance (TAB), a pre-determined amount which acts as a deposit for the payment of tolls. Each time your account balance falls under $10.00, your credit card will be charged to re-establish the TAB. No account will be permitted to have a negative balance. If the customer begins using the ExpressToll account more frequently, the TAB will be increased to an amount equal to the average monthly usage. It is important that the customer inform the ExpressToll Service Center of any changes to their credit card. The customer agrees to pay a non-refundable returned item fee of $30.00 for each transaction refused by your bank or credit card issuer.

Check-Based Account: Check-based accounts are established similar to credit card-based accounts. The customer establishes the ExpressToll account initially, by paying a Toll Account Balance (TAB) of $35.00 minimum. If the customer begins using the ExpressToll account more frequently, the TAB will be increased to an amount equal to the average monthly usage. Payments are to be made within 10 business days from the date of the ExpressToll billing statement. The customer agrees to pay a non-refundable returned item fee of $30.00 for each transaction refused by your bank or debit card issuer.

RESPONSIBILITY FOR TOLL CHARGES

The customer to whom an ExpressToll Transponder/Pass has been issued is responsible for all toll charges assessed against the account until the account is closed. This is true even if a Transponder/Pass is lost or stolen. If such a loss or theft of any Transponder/Pass occurs, it is important that the customer notifies the ExpressToll Service Center immediately by calling locally at 303-537-3470, or from outside Denver at 1-888-946-3470. In case of loss or theft, a replacement sticker tag will be issued, or a replacement Switchable HOV Transponder/Pass may be purchased. The customer's TAB will be credited for any charges made in error due to loss or theft. Should a dispute occur over a toll charge, the ExpressToll Service Center will provide the customer, at the customer's request, an itemized statement listing the disputed transaction(s).

If requested by the customer, emailed monthly statements are provided free of charge. Mailed monthly statements are optional and can be requested. A monthly service fee of $2.00 will be deducted from the customer's TAB for mailed monthly statements. If you fail to keep the required minimum balance in your ExpressToll account, it is agreed that the ExpressToll Service Center may deactivate the ExpressToll Transponder/Pass(s) assigned to the account. Continued use of the ExpressToll Transponder/Pass after such deactivation will be treated as a toll violation subject to applicable fees and civil penalties as established by the ExpressToll policy. If for any reason your TAB has insufficient funds, you are liable until said fees and civil penalties are paid.

CLOSING AN EXPRESSTOLL ACCOUNT ยท REFUND OF A TAB

The customer will receive a refund of the balance remaining in their TAB. This refund will be made to the credit card account used to establish the ExpressToll account, unless the credit card account has been closed. Check paying customers will receive a refund check issued within thirty (30) days. The cost of the Switchable HOV Transponder/Pass is not refundable.

TRANSPONDER/PASS USE

A Transponder/Pass may only be used on the vehicle to which it is registered and assigned. A sticker tag type Transponder/Pass is automatically deactivated when it is removed from the windshield. If a Transponder/Pass is deactivated, a replacement sticker tag will be provided at the customer's request. If a replacement Switchable HOV Transponder/Pass is requested, it may be purchased from the ExpressToll Service Center. If the customer owns a Switchable HOV Transponder/Pass and would like to move it to a new vehicle, he/she must contact the ExpressToll Service Center to update the information on the ExpressToll account. Each vehicle on the ExpressToll account must have a designated Transponder/Pass.

EXPRESSTOLL CUSTOMER RESPONSIBILITIES

Notify the ExpressToll Service Center immediately if your credit card has been lost or stolen, the expiration date of the credit card changes, your credit card limit has been reached, the credit card account has been closed, or if the account number or issuing bank changes. Notify the ExpressToll Service Center immediately of a changed mailing address and/or phone number, and automobile registration or license plate change. Failure to notify the ExpressToll Service Center of a transfer of a transponder/pass to another vehicle, or of any change in your license plate or vehicle registration may result in a $10.00 penalty assessed to your ExpressToll account.

E-470 will charge the License Plate Toll rate for all tolls associated with vehicles not listed on a customer's ExpressToll account.

Switchable HOV Transponder/Pass and Express Lanes

The Switchable HOV Transponder/Pass provides additional functionality to permit users to identify when their vehicle can be classified as a High Occupancy Vehicle (HOV) only on specific CDOT HOV facilities that offer HOV discounts / free tolls. Any user of a Switchable HOV Transponder/Pass agrees:

  • If the Switchable HOV Transponder/Pass is switched to "TOLL" when traveling the HOV facility, regardless of the number of occupants, no HOV discount will be applied to the customer account.
  • To only adjust the Transponder/Pass HOV/TOLL switch when it is safe to do so. For maximum safety, the Switchable HOV Transponder/Pass should be set to the desired switch position before starting, and not during a trip that will pass through an HOV facility. The position of the Switchable HOV Transponder/Pass must be changed to "HOV" prior to entering the HOV facility express lane. Switching of the Transponder/Pass to HOV while in the express lane may result in tolls due, which will not be credited.
  • To only place the Transponder/Pass in HOV mode with the proper number of occupants in the vehicle in accordance with HOV facility signage.
  • Violations of the HOV mode, resulting from operating a vehicle with less than the required number of occupants, is a violation of Colorado Revised Statutes and could result in a traffic infraction(s) and/or termination of this Agreement.
  • That the Switchable HOV Transponder/Pass will function as a standard ExpressToll Transponder/Pass regardless of switch position on Toll Facilities which do not offer HOV discounts.
  • HOV discounts do not apply to vehicles with more than three axles, regardless of the Transponder/Pass switch setting.
  • To pay the displayed toll rate if the digital message signs indicate tolls are in effect.
  • That you may incur up to the maximum toll rate if you travel on an HOV facility express lane that is closed, as indicated on digital message signage, in addition to other possible penalties including, but not limited to, violations under Colorado Revised Statutes and/or termination of this Agreement.

MISCELLANEOUS

The customer agrees to all terms, provisions, and conditions of the Agreement as a condition of use of the ExpressToll account. ExpressToll reserves the right to modify the terms of this Agreement at any time. Changes to the Agreement will be posted at www.expresstoll.com. By continued use of the ExpressToll account after modification of the Agreement, the customer agrees to be bound by any changes to the Agreement. The customer agrees to pay all reasonable charges, fees, and costs, including attorney's fees, incurred by ExpressToll to enforce the terms of this Agreement.

Promptly review your statement and notify the ExpressToll Service Center with questions regarding any ExpressToll charges. Charges not questioned within thirty (30) days of the ExpressToll Service Center's issuance of the statement will be deemed acceptable to the ExpressToll customer.

ExpressToll reserves the right to close an ExpressToll account or deny use of ExpressToll service for any reason.
